THE TOWN OF MAMAKATING TOWN BOARD MEETING HELD ON TUESDAY, AUGUST 2, 2011 AT 6:00 P.M. IN THE TOWN HALL, 2948 ROUTE 209, WURTSBORO, N.Y.

CALL TO ORDER/PLEDGE OF ALLEGIANCE

 

The August 2, 2011 meeting was called to order at 7:00 p.m. with the pledge to the flag. All members present.

A moment of silence was observed in memory of John Bryan, Past Chief of the Wurtsboro Fire Department and one of the first commissioners appointed to the Wurtsboro Fire District.

SUPERVISOR’S REPORT

 

  • Ø      General/Payroll Fund: $989,138.74

ABSTRACTS

 

  • Ø      A motion to approve ABSTRACT # 14 (Voucher # 1028-1058) in the amount of $63,623.31 was made by J. Moul, seconded by R. Saunders. All in favor.
  • Ø      A motion to approve ABSTRACT #15 (voucher # 1059-1175) in the amount of $100,039.37 was made by J. Moul, seconded by E. Brebbia. All in favor.

 

 

RESOLUTIONS

  • Ø      A motion was made by J. Moul, seconded by E. Brebbia to accept two private road names – Martello and Seigel - for 911 purposes. All in favor.
  • Ø      A motion approving the request for $200.00 for the Sullivan County Senior Games was made by J. Moul, seconded by R. Saunders. All in favor.
  • Ø      A motion approving the use of the of the park building by the Library on September 7, 2011 and at other times authorized by the supervisor was made by E. Brebbia, seconded by R. Justus. All in favor.
  • Ø      A motion releasing the logging bond of Wagner Logging in the amount of $3,000.00 at the request of the highway superintendent was made by E. Brebbia, seconded by R. Justus. All in favor.
  • Ø      A motion authorizing the supervisor to request that our town engineer do a survey of the repairs needed at the park in areas affected by the storms was made by J. Moul, seconded by E. Brebbia. All in favor.
  • Ø      A motion was made by J. Moul, seconded by E. Brebbia to allow Camp Kaylie to put signage no larger that 24x36 at the corners of Summitville Road and Mt. Vernon Road. All in favor.
  • Ø      A motion authorizing the supervisor to direct the town engineer to prepare bid specifications for the repair of the Town Hall roof was made by R. Saunders, seconded by E. Brebbia. All in favor.

Councilperson E. Brebbia offered the following Resolution, who moved for its adoption.

 

            WHEREAS, the Town Board of the Town of Mamakating has heretofore, pursuant to Town Code, Article 68, directed and authorized the Superintendent of Highways of the Town of Mamakating to forthwith remove from the premises located at 113 Pickles Road (Tax Map No. 21-1-48.44) the dangerous and unsafe partially dismantled structure (mobile home) garbage refuse, construction and other debris from said premises in accordance with Section 68-9(A) of the Town Code of the Town of Mamakating, and to thereupon submit a voucher to the Town Board of the Town of Mamakating setting forth the labor costs, expenses and other disbursements which it incurs in connection with said work, and

 

            WHEREAS, in performing said work, the Town Highway Superintendent was required to contract with Pine Bush Equipment Co., Inc., Thompson Sanitation Corp. and Sullivan County DSW-Scale in connection with obtaining equipment and disposing of debris, and

 

            WHEREAS, the Highway Superintendent of the Town of Mamakating has presented invoices to the Town Board of the Town of Mamakating for payment from the General Fund in the total sum of Ten Thousand Five Hundred Sixty-Eight and 30/100 ($10,568.30) Dollars, as set forth in the Schedule attached as Exhibit “A”, and

 

            WHEREAS, the Town Attorney has submitted vouchers to the Town Board of the Town of Mamakating in the total sum of One Thousand One Hundred and 00/100 ($1,100.00) Dollars, as set forth in the Schedule attached as Exhibit “A”, and

 

            WHEREAS, the Town of Mamakating has further incurred service and other fees in the sum of Two Hundred Sixty-Seven and 00/100 ($267.00) Dollars, as set forth in the Schedule attached as Exhibit “A”, and

 

WHEREAS, by Resolution of the Town Board of the Town of Mamakating dated May 3, 2011, the Town Board of the Town of Mamakating Resolved that all expenses incurred by the Town in connection with the clean up and removal of the partially dismantled structure (mobile home), garbage, refuse, construction and other debris strewn about the property of Louise Bennett in connection with the proceeding, including the actual cost of removing said partially dismantled structure (mobile home), garbage, refuse, construction and other debris, disposing of the same and all reasonable and necessary engineering and legal expenses incidental thereto shall be assessed against the land and shall

be levied and collected in the same manner as provided for in Article 15 of the Town Law for levy and collection of special ad valorem taxes, and

WHEREAS, the Town Board of the Town of Mamakating further Resolved on May 3, 2011 to schedule a hearing on the assessment of the expenses in accordance with the Code of the Town of Mamakating, Section 68-9C (1), (2) and (3).

 

            NOW, THEREFORE, the Town Board of the Town of Mamakating, in a regular session duly convened, resolves as follows:

 

            1.         After consideration of the invoices and vouchers received by the Town Board of the Town of Mamakating and pursuant to provisions of Section 68-9C(1), (2), (3) to cause to be served upon Louise Bennett a Notice which shall contain in sum and substance the following statements:  (a) the name of the owner against whose property an assessment of expenses is being sought; (b) a brief description of the premises and its location; (c) that the Town Board has previously issued an order directing the owner of the premises to complete the work specified therein; (d) that the work was not completed as requested by the order; (e) that the Town took action in order to make the building or structure safe and secure or removed and demolished; (f) that the Town incurred expenses in the total sum of Eleven Thousand Nine Hundred Thirty-Five and 30/100 ($11,935.30) Dollars as a result; (g) that the Town is seeking to assess said expenses against the land on which such dismantled structure, garbage, refuse, construction and other debris was located; (h) that a Public Hearing in this matter shall be held before the Town Board of the Town of Mamakating on September 6, 2011 at 7:00 p.m. at the Town Hall of the Town of Mamakating, 2948 State Route 209, Wurtsboro, New York, at which time the owner or her representative or agent shall have the right to contest the amount of expenses to be assessed or collected; (i) that in the event that such owner or his representative or agent shall fail to appear and/or fail to successfully contest such expenses, the Town Board shall levy such expenses against the land described in the notice and shall collect them in the same manner as provided in Article 15 of the Town Law for the levy and collection of a special ad valorem levy.

 

            2.         Service of the Notice shall be made in the manner specified in subsections (a) and (b) of Section 68-7 of this Chapter.           

 

            3.         This Resolution shall take effect immediately.

 

            Seconded by R. Saunders and after duly put to a vote resulted as follows:

MINUTES

  • Ø      A motion accepting the minutes of July 5, 2011 with the addition of “authorizing the acceptance of the second lowest quote for the removal of the trees at the park should the lowest bidder not be able to perform the job was made by J. Moul, seconded by H. Baird. All in favor.

 

EXECUTIVE SESSION

  • Ø      A motion was made by J. Moul, seconded by E. Brebbia to go into executive session at 8:05 p.m. for legal advice and litigation. All in favor.
  • Ø      A motion to come out of executive session at 8:38 p.m. was made by E. Brebbia, seconded by R. Saunders. All in favor.

 

HIGHWAY NEGOTIATOR

  • Ø      A motion was made by J. Moul, seconded by R. Saunders to hire Michael Richardson, a negotiator, at a rate of $150.00 per hour up to $5,000 and authorizing the supervisor to sign the retainer contingent upon the results of the meeting scheduled for Thursday with the highway negotiating team, H. Baird and R. Saunders. 3 ayes, 2 nays (E. Brebbia, R. Justus). Motion carries.

 

ADJOURNMENT

 

A motion was made by E. Brebbia, seconded by R. Saunders to adjourn the meeting at 8:45 p.m. All in favor.
